After he departed to France, DNA tests showed that he in fact was the father of the babies. The man has denied the findings and is refusing to return to Korea. He remains listed as a witness, and not a suspect.

"In many criminal cases, the culprit turns out to be the person who first notified the police. It escapes me as to why the police ruled that possibility out for this case," said Lee Hun, a lawyer heading a local organization of right-wing attorneys.

According to local laws, unless a person has been booked or has received a custodial sentence of three or more years, the Justice Ministry is not authorized to block his departure.

"If the government bans foreigners from departing on terms other than those, it would be under huge pressure from the international community," said a Justice Ministry official who declined to be named.

Laws are also more relaxed toward the departure of foreigners compared to Koreans, the official explained.

"Koreans are allowed more freedom than foreigners when entering their home country. So the rule is, foreigners are given more freedom when leaving Korea," he said.

Even if the Frenchman is found guilty of crimes related to the dead infants, the police would at most receive a notice from the French government saying they have referred the case to their own courts.

"According to a mutual agreement, France may reject requests to send suspects to the country where they allegedly committed the crime," said Jeon Seong-won, a prosecutor at the Justice Ministry`s international criminal department.

But even this agreement, which is part of an ad hoc treaty, has yet to be set in stone since ratification is still pending in the National Assembly. So for most part, Jeon says the investigation will depend on how willing the Frenchman is to cooperate.

On July 25, the Frenchman reported to the police that he found two infant corpses in his freezer. He said he and his family had left for vacation to France in late June but that he was back for a meeting. The man departed the country a few days later promising to cooperate with the police.

경찰은 2주전 냉동고 안에서 영아 두명의 시신을 발견한 40세의 프랑스인 집주인의 신병을 확보하지 못한 데 대한 집중 비난을 받고 있다.

프랑스인 집주인이 프랑스로 출국한 뒤 DNA 검사 결과 그가 사망한 영아들의 아버지로 밝혀졌다. 그는 DNA 검사 결과를 부인하며 귀환을 거부하고 있다. 그는 여전히 피의자 신분이 아닌 목격자 신분을 유지하고 있다.

“범죄 사건의 경우 경찰에 맨 먼저 신고한 사람이 범인인 경우가 많다. 이번 사건의 경우 경찰이 그러한 가능성을 배제한 이유를 알 수 없다”고 시민과 함께하는 변호사들 사무총장 이헌 변호사는 말했다.

국내법에 따르면 수감생활을 했거나 3년 이상의 집행유예 선고를 받지 않은 경우 법무부는 해당 인의 출국을 금지할 수 없도록 되어 있다.

“그 이외의 조건으로 외국인의 출국을 정부가 금지할 경우 국제사회의 거센 압박을 받게 될 것이다”라고 익명을 요구한 한 법무부 관계자는 말했다.

또 내국인에 비해 외국인의 출국의 경우에 대해선 법이 보다 완화되었다고 관계자는 설명했다.

“국내로 입국하는 경우 내국인은 외국인보다 간소한 절차를 거친다. 따라서 출국 시에는 외국인들이 내국인보다 간편한 절차를 거치는 것이다”라고 그는 말했다.

심지어 프랑스인 집주인이 영아 유기 사건의 범인으로 판명된다 하더라도 경찰은 기껏해야 해당 사건을 프랑스 법원에 회부했다는 프랑스 정부의 통보를 받는게 고작일 것이다.

“양국간 협정에 따라 프랑스는 피의자가 범죄를 저지를 국가로 해당 피의자를 송환해 달라는 요청을 거부할 수 있다”고 법무부 국제형사과 전성원 검사는 말했다.

그러나 특별 조약의 일부인 이러한 협약조차도 비준안이 여전히 국회에 계류 중이기 때문에 확정된 것은 아니다. 따라서 전 검사는 수사가 프랑스인 집주인의 협조 여부에 상당 부분 달려 있다고 말했다.

7월 25일 프랑스인 집주인은 자신의 냉동고 속에서 두명의 영아 시신을 발견했다고 경찰에 신고했다. 그는 그와 가족들이 6월말 프랑스로 휴가를 떠났지만 자신은 회사 회의를 위해 돌아왔다고 말했다. 그는 경찰에 협조할 것을 약속하며 몇일 뒤 프랑스로 출국했다.
